The Motor Carrier Division does not have jurisdiction over consent tows as they are an agreement between the tow truck motor carrier and the customer. These matters are considered "civil" in nature and should be handled with an attorney through civil claims court if you cannot find resolution. However, the Motor Carrier Division does have limited jurisdiction regarding your ability to obtain your personal belongings during business hours (M-F, 7 a.m. - 6 p.m.). Tow companies, regardless of consent or non-consent tows, must allow you to obtain your belongings during regular business hours at no cost. If the tow truck company you selected to tow your vehicle charges you a fee to collect your personal belongings (not your vehicle) during regular business hours, please submit this form and you'll be assigned a tracking number.
Please note that tow companies can charge a fee if you cannot pick up your vehicle but need to collect your personal belongings after hours or on weekends. The Motor Carrier Division does not have jurisdiction over the fee charged for after hours and weekend requests to collect your belongings.
